Description: The transboundary shipment of waste has been regulated since 12 July 2007 by Regulation (EC) 1013/2006 on shipments of waste (Waste Shipment Regulation). On 30 April 2024, the new Regulation (EU) 2024/1157 on shipments of waste was published in the official Journal of the EU. This came into force on 20 May 2024. However, due to the extensive changes compared to the existing Waste Shipment Regulation (EC) 1013/2006, the new regulation will only apply from 21 May 2026. This gives all affected authorities, shippers, recipients, transporters and other stakeholders sufficient time to adapt to the new regulations. The most important innovations of the Waste Shipment Regulation (EU) 2024/1157 concern the following aspects: Switching from paper-based to electronic data exchange between authorities and authorities and economic operators, Adaptation and concretisation of the regulations on the notification procedure and the general information obligations for green-listed waste to electronic data exchange, Making it more difficult to ship waste for disposal in order to promote the recovery of waste in the producer countries, Improving the fight against illegal waste shipments through greater cooperation between EU countries and stricter regulations, including on the inspection of recovery facilities in third countries by notifiers in the EU, Stricter requirements for the export of waste from the EU to prevent the transfer of European waste problems to third countries, including a ban on the export of plastic waste to non-OECD countries Further information and resources on the following topics can be found on the topic pages of the Federal Ministry for the Environment and the German federal environment agency, the Umweltbundesamt: Legal and technical bases and statistics on waste shipments Supplementary provisions of Regulation (EC) 1418/2007 on the export of green-listed waste to non-OECD countries Amendments and additions to Regulation (EC) 1013/2006 (forms, instructions for filling those forms) Implementation guidelines adopted by the LAGA on the Waste Shipment Regulation and instructions for co-operation between customs and supervisory authorities In connection with the Waste Shipment Regulation (EU) 2024/1157, the following transitional provisions must be observed for new and existing shipments and notifications: Application of the Waste Shipment Regulation (EU) 2024/1157 from 21 May 2026, Export of green-listed waste to non-OECD countries until 21 May 2027 according to the old „Staatenliste“ (list of countries), thereafter according to a new list of countries of the EU Commission, General ban on the export of plastic waste (waste code B3011 or EU3011) to non-OECD countries from 21 November 2026, Application of the Waste Shipment Regulation (EC) 1013/2006 to notified shipments with acknowledgement of receipt from the recipient authority before 21 May 2026 with completion of the shipment by 21 May 2027, Completion of shipments with existing pre-consent by 21 May 2029. The European legal bases are supplemented and concretised by the German „Waste Shipment Act“ (Abfallverbringungsgesetz), which came into force on 28 July 2007. The provisions of the Waste Shipment Act and its subordinate legislation (Waste Shipment Fines Ordinance, Waste Shipment Fees Ordinance, customs offices, bilateral agreements) can also be viewed on the website of the Federal Ministry for the Environment. To explain the provisions of the Waste Shipment Act and the Waste Shipment Ordinance, the ‘Enforcement Aid for Waste Shipments’, LAGA Communication 25 (as of May 2017), has been introduced in Saxony-Anhalt. The LAGA Communication 25 will be updated to represent the new Waste shipment Regulation (EU) 2024/1157. Notifications or notices for the shipment of Green List waste to and from Saxony-Anhalt are the responsibility of the Landesverwaltungsamt (LVwA) for all types of disposal except underground landfills and mine backfilling the Landesamt für Geologie und Bergwesen (LAGB) for underground landfills and mine backfilling The Umweltbundesamt is the competent authority for the transit of waste through Germany. Since 1 September 2001, the state treaty on the formation of a joint institution in accordance with § 6 of the Waste Shipment Act has been in force. This simplifies the enforcement of the return of shipped waste in certain cases (e.g. where several state authorities are responsible) by bundling the enforcement responsibility with the state of Baden-Württemberg. The SAA Sonderabfallagentur Baden-Württemberg GmbH is currently responsible there. According to § 11a of the Waste Shipment Act in conjunction with Art. 50 Par. 2a of the Waste Shipment Regulation (EC) 1013/2006, the member states must draw up control plans for their area of responsibility for controls in accordance with § 11 Par. 1 and 2 of the Waste Shipment Act.
