Rechtliche Umsetzung der EU-Emissionshandelsrichtlinie

Description: Begleitung der Aufgaben des BMU im Zusammenhang mit den fortlaufenden Rechtssetzungsarbeiten und Vollzugsfragen zur Implementierung des Emissionshandels in Deutschland. Bis Ende 2004 sollen die Verordnungen zur Umsetzung des TEHG und der Vollzug des Gesetzes zum Nationalen Zuteilungsplan 2005-2007 (ZuG I) und seiner Verordnungen erlassen sein. Bis Ende 2005 ggf. Korrektur des ZuG 2007 gemäß Entscheidung KOM zum NAP I. Das Gesetzgebungsverfahren zum Zweiten Nationalen Allokationsplan (2008 -2012) ist bis zum 30. Juni 2006 abzuschließen. Die zugehörigen Verordnungen sind spätestens bis zum 30.9.2006 anzupassen. a) Gesetzesänderungen und Erlass von RechtsVO auf der Basis TEHG und ZuG 2007. Änderung des TEHG zur Überführung von JI/CDM-Gutschriften nach Inkrafttreten der EU-linking directive. Änderung des ZuG 2007 zur Anpassung an Entscheidung KOM zum NAP 1. Verifizierung der Zuteilungsanträge - Bekanntgabe des Sachverständigen. Vorläufige Grundlage für Bekanntgabe der Verifizierer und Kriterien für Verifizierung vor Beginn der Zuteilungsverfahren. VO zur Verifizierung der Zuteilungsanträge. Kriterien für Verifizierung und Verifizierer samt Regelung der Bekanntgabe.

  Title: Legal implementation of the European directive on emissions trading
  Description: Ecologic was commissioned to analyse the legal preconditions and to prepare the legal basis for the German implementation the EU Directive in respect of a European emissions trading system. In this context, the Greenhouse Gas Emissions Law (TEHG), which provides the guidelines for the German implementation of an emissions trading system, was drafted, as well as the Allocation Law (Zuteilungsgesetz, ZuG 2007), which complements it. Furthermore, drafts of the Allocation Regulation (Zuteilungsverordnung, ZuV) and of the Cost Regulation (Kostenverordnung, KostenV) were elaborated. Questions needed to be resolved concerning the compatibility of this new instrument with the existing Federal Emissions Protection Regulation, the distribution of competences between the Federal Government and the Federal States and concerning legal protection and protection of confidence in connection with the various obligations of the installations participating in emissions trading. The different models for the allocation of allowances needed to be analysed in particular with regard to their compatibility with the fundamental rights and the European Law of State Aid.In succession the research project comprised legal assistence in implementing the flexible mechanisms (Clean Development Mechanism, Joint Implementation) of the Kyoto-Protokoll. The Law to be drafted had to provide regulations for the process of generating certificates out of CDM and JI projects with participation of Germany as investing and/or host country. As well the provisions for the use of these certificates within the national trading system were part of the draft. On the European level the so called Linking Directive had to be implemented, on the international level the Kyoto-Protokoll, the UNFCCC and the Marrakesh Accords form the legal frame. At present legal questions occuring with the implementation are being analysed and concretising regulations are being drafted.
