Die europäische Beihilfenaufsicht im Umweltschutz - Analyse und Kritik des neuen Gemeinschaftsrahmens

Description: Untersuchung des neuen 'Gemeinschaftsrahmens für Umweltschutzbeihilfen' der Europäischen Kommission auf Kohärenz von Wettbewerbsschutz- und Umweltschutzziel nach Maßgabe des Integrationsgebotes in Art. 6 EG V. Inhaltliche und z.T. empirische Überprüfung der einzelnen Regelungsmechanismen des Gemeinschaftsrahmens hinsichtlich ihrer Wettbewerbs- und umweltpolitischen Konsequenzen für EU-Mitgliedstaaten und die Gemeinschaft sowie hinsichtlich ihrer Praktizierbarkeit. Ausgewählte Ergebnisse: Das von der Kommission in der Beihilfenaufsicht verwendete Wettbewerbsparadigma greift im Bereich der Umweltpolitik zu kurz, da es allokative Verzerrungen des Wettbewerbs durch externe Effekte ignoriert. Daraus - und aus unzureichender Berücksichtigung des Integrationsgebots - folgen diverse Hindernisse für fortschrittliche Umweltpolitik in der Gemeinschaft, die nicht mit einem verbesserten Wettbewerbsschutz einhergehen. Betroffen sind vor allem 'moderne' Bereiche, wie ökologische Besteuerung, kooperativer Umweltschutz und prozessintegrierter Umweltschutz.

  Description: Investigation of the new 'Community framework for environmental protection aids' of the European Commission for coherence of competition protection goal in accordance with protection with the requirement for integration in Art. 6 EC Treaty.
