Umweltinspektionen als Instrument für eine bessere Umsetzung des EU-Umweltrechts

Description: Die Verbesserung der Implementation und Durchsetzung des Europäischen Umweltrechts wird eines der wesentlichen Ziele des 7. Umweltaktionsprogramms der Europäischen Union (EU) sein. In einem Bericht für die Europäische Kommission analysieren das Ecologic Institut, BIO Intelligence Services and Institute for European Environmental Policy verschiedene Optionen die Implementation und Durchsetzung der EU Umweltgesetzgebung zu verbessern - insbesondere durch eine Stärkung der Rolle der Kommission bei Umweltinspektionen und ihrer Kapazitäten, Verstösse gegen das Umweltrecht zu untersuchen. Innerhalb des Projektteams beschäftigt sich das Ecologic Institut hauptsächlich mit der Analyse von zwei Optionen: die erste betrifft die Schaffung eines allgemeinen Mechanismus der es der Kommission ermöglicht, die Inspektionssysteme der Mitgliedstaaten zu prüfen und der ein entsprechendes Berichtssystem schafft. Ein solches Audit könnte sich am Model des Food and Veterinary Office (FVO) der Europäischen Kommission orientieren, das in Reaktion auf die BSE-Krise geschaffen wurde. Die zweite Option betrifft eine gezieltere Schaffung von neuen Befugnissen der Europäischen Kommission im Rahmen von spezifischer sektoraler EU Umweltgesetzgebung. Auf Basis der Analyse der verschiedenen Optionen entwickeln alle Projektpartner gemeinsam Kombinationen von Optionen, die den höchsten Mehrwehrt hinsichtlich einer Stärkung der Rolle der EU im Bereich der Umweltinspektionen und bezüglich der Kapazitäten Untersuchungen durchzuführen, versprechen.

  Title: Environmental inspections as tool for a better implementation of EU environmental law
  Description: Improving the implementation and enforcement of European environmental legislation will be one of the key priorities of the EUs upcoming 7th Environmental Action Programme. In a report for the European Commission Ecologic Institute, together with Bio Intelligence and the Institute for European Environmental Policy, is studying several options to improve the implementation and enforcement of EU environmental policy by strengthening the European Commissions role in environmental inspections and its capacity to investigate breaches of EU environmental legislation. Within the project team, Ecologic Institute mainly focuses on the analysis of two options: the first one concerns the establishment of a general mechanism within DG Environment for reviewing and reporting on the functioning of the Member States inspection systems. Such an audit mechanism could be modelled on the European Commissions Food and Veterinary Office, which was established in the aftermath of the BSE-crisis ( mad cows). The second option concerns a more targeted establishment of ad hoc inspection-related powers for the Commission in specific pieces of sectoral EU environment legislation.
